Terms of Service

By accessing or using the Services, you agree to be bound by these Terms, whether on your own behalf or on behalf of a company or other legal entity. If you are entering into these Terms on behalf of an entity, you represent that you have the authority to bind that entity, in which case “you” and “your” refer to that entity. If you do not agree to these Terms, you may not access or use the Services.

We may revise these Terms from time to time. If we make material changes, we will notify active customers by email with a summary of the key updates. Continued use of the Services after the effective date of a change constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.

Subject to these Terms, Echooo grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business purposes — namely, discovering, engaging, and managing content creators for marketing campaigns (if you are a Brand Customer), or being discovered and engaged for campaigns (if you are a Creator Customer). All restrictions on use are set out in Section 10 (Restrictions).

We may modify, suspend, or discontinue any part of the Services at any time. We use commercially reasonable efforts to keep the Services available, except for planned maintenance (of which we will try to give reasonable advance notice) and events outside our control. We do not guarantee uninterrupted or error-free access to the Services.

We provide reasonable technical support in accordance with our standard practices. We may suspend or restrict your access to the Services for non-payment or material breach of these Terms, as described in Section 12 (Cancellation & Termination).

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. You may only maintain one account per person unless we agree otherwise in writing.

Our collection and use of personal data in connection with the Services is described in our Privacy Policy, which is incorporated into these Terms by reference.

Where you use the Services to access personal data about creators or their audiences (“Creator Data”), you acknowledge that you may become an independent controller of that data for purposes of applicable data protection law, including the GDPR where it applies to you. As between you and Echooo, each party is an independent controller with respect to Creator Data — we do not jointly determine the purposes and means of processing that data with you.

Where Echooo processes personal data on your behalf as a processor (for example, in relation to in-platform communication features), we will do so only on your documented instructions and in accordance with applicable data protection law.

If you are a Brand Customer, you agree to collect, use, and disclose Creator Data only in a fair and lawful manner, and to respect creators’ reasonable expectations of privacy. You are responsible for obtaining any consent required by applicable law before using Creator Data for your own purposes outside the Services, and for complying with the platform’s and any linked third party’s (including Meta’s) terms when contacting creators.

We may suspend or terminate your access to the Services, without notice, if we determine you have violated this Section or otherwise engaged in unlawful or unethical handling of Creator Data.

Certain features of the Services are subject to fees, as described on our Pricing page or in a separate order form or agreement with you. Our current plans, billing cycle, renewal, and refund terms are being finalized and will be published here and on the Pricing page before general availability.

The Services may show payment or invoice status between Brand Customers and Creator Customers for record-keeping purposes. Unless otherwise agreed in writing, Echooo does not hold, transfer, or take custody of funds between Brand Customers and Creator Customers — payment for creator services is arranged directly between the parties, outside the Services.

Data and content made available through the Services (including creator profiles, audience insights, and campaign analytics) is provided for informational purposes only. We do not guarantee that this data is accurate, complete, or up to date, and it may not be used for any purpose related to credit, insurance, employment, or other eligibility decisions about an individual.

Our Services use autonomous AI agents to support campaign discovery, outreach, content management, and analytics, as described in our Privacy Policy. We do not use personal data processed through the Services to train our own AI models, and we do not permit our service providers to use such data to train or improve their models.

We may aggregate or anonymize data collected through your use of the Services and use it to improve and develop our products, without identifying you or any individual.

You agree not to:

• Scrape, crawl, or use automated tools to extract data from the Services beyond the functionality we intentionally provide;
• Copy, modify, resell, sublicense, or redistribute the Services or the data made available through them to third parties, except that agencies with an active subscription may use the Services in the ordinary course of serving their own clients, provided the agency remains the contracting party with Echooo;
• Reverse-engineer, decompile, or attempt to extract the source code of the Services;
• Use the Services in a way that harms, disables, overburdens, or interferes with the Services or other users’ use of them;
• Use the Services to harass, impersonate, or compile false or misleading information about any person;
• Use the Services to gain unauthorized access to any account, system, or network;
• Violate the intellectual property or other proprietary rights of any third party through your use of the Services;
• Create multiple accounts for disruptive, abusive, or fraudulent purposes.

Violation of this Section is a material breach of these Terms and may result in immediate suspension or termination of your access to the Services.

You grant us the right to include your company name and logo in our customer list, website, and marketing materials, and to reference publicly available information about your campaigns (such as performance results) in case studies, provided we do not disclose any confidential or proprietary information without your consent. Neither party may otherwise use the other’s name, logo, or identifying information without prior written consent.

You may stop using the Services at any time. We may suspend or terminate your access to the Services, with or without notice, for non-payment, breach of these Terms (including Sections 7 and 10), extended inactivity, or as required by law.

Upon termination, your right to access the Services ends immediately, and you must delete any data you received from Echooo through the Services, except to the extent retention is required by law. Sections 6, 9, 11, 13, 14, 15, and 16 survive termination of these Terms.

Echooo and its licensors retain all rights, title, and interest in and to the Services, including our software, platform, brand, and the compilation of data made available through the Services. Nothing in these Terms transfers ownership of our intellectual property to you. If you provide us feedback about the Services, we may use it without restriction or obligation to you.

The Services and any data or content made available through them are provided “as is” and “as available,” without warranties of any kind. We are not liable for the content of any agreement between you and a creator, the performance or non-performance of a creator’s services, or the accuracy of data sourced from third parties (including InsightIQ or public social media profiles).

To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or the Services is limited to the total fees you paid us in the 12 months preceding the claim. You agree to indemnify us against third-party claims arising from your misuse of Creator Data or violation of these Terms.

These Terms are governed by the laws of Pakistan, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will first be addressed through good faith negotiation between the parties. If a resolution cannot be reached, the dispute will be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.

Each party may receive confidential information from the other in connection with the Services. Each party agrees to protect the other’s confidential information with the same degree of care it uses for its own confidential information (and no less than reasonable care), and to use it only for purposes consistent with these Terms. This obligation does not apply to information that is or becomes publicly available through no fault of the receiving party, was already known to it, or is independently developed.
